The conduct of our organizations continues to be significant and frequent penalties, without realizing it or Assembly reports, or statements of income, or social reports. Would still have to say that neither the media are concerned mainly with the issue. This note aims to bring the reader look very acceptable on this side of organizations, with the sole purpose of making visible the fact that inappropriate behavior will help to improve the necessary social control over our organizations.




During 2009, the Superintendency of Industry and Commerce of Colombia fines imposed a total 1,769, with a total value of $ 9,992,210,499 (5.2 million). These figures represent a decrease of 2.8% in the number of penalties and 28.4% in the total tax. Is this good news, although there does make two important observations:
1. Remain unacceptably high and worrisome: average daily fines of nearly 5 and a monthly average of over $ 833 million pesos , all of which comes from the pockets of consumers and workers without our knowledge and inform us.
2. And this is just the tip of the iceberg for many reasons: the vast majority of inappropriate behaviors are not punished, either for lack of consumer complaints, either because of inefficiency of public administration, in addition, this paper concerns only one of many superintendents that exist, and, finally, here not considered other penalties resulting from guardianships, litigation, etc.

Now, in three scenes, some detailed above:

SCENE 1: Companies frequently punished
Graph No. 1, the reader can find the list of the top 10 companies sanctioned during the year . I mention the sector, deliberately omitting the name of the company, for two reasons:
1. I consider that our society does not have the political maturity necessary to ventilate these issues with proper names, and
2. Why use names can lead to the false dilemma about companies responsible and irresponsible companies, when the reality is that the real dividing line is between responsible practices and responsible practices that often coexist in the same company at the time.

Figure No. 1 gives a sample representing 42.6% of the total number of penalties imposed. Several useful comments on this first scene:
1. 9 of the 10 companies also feature on the Top Ten of 2008 , which is beginning to establish a style of conduct error-resistant, which is worrying.
2. sectors of Telecommunications and Retail Trade sectors remain critical , as in 2008. Is it not time that the bodies of management control public to take note and to intervene actively and not reactively in these sectors?
3. The most critical and telecoms company, despite the restructuring that suffered under the government of President Uribe, records a monthly average of 26.6 penalties, with an increase of 33.3% over the previous year. One fine day, gentlemen!

4. The most relevant causes sanction were, in order: consumer complaints (44.5%), silence of the companies (40.2%), and effectiveness of guarantees (7.0%). good news that consumer reaction , poor of the silence organizations.

SCENE 2: sanctioned companies
Graph No. 2, you can see the top ten companies receiving the largest amount by way of sanctions. Several comments are also relevant:
1. Leaving aside some individuals, Telecommunications sectors Food and dominate the scene.

SCENE 3: the largest fines imposed
Graph No. 3, we can finally see the highest individual fines imposed during the year. It just comment that the first eight fines correspond to RBP , reinforcing the comments of Scene 2.

CONCLUDING

Despite a year improvement in the figures, I conclude that, despite so much speech about socially responsible, although the same Social Responsibility Survey of Colombian entrepreneurs tells us that "over 90% of executives shares CSR forward" despite the growing wave of sustainability reports published and of joining the Global Compact, although both speech, again, actual behavior-and I stress the word REAL-of our organizations is still very questionable.
